{"id":348,"date":"2018-08-31T14:11:54","date_gmt":"2018-08-31T18:11:54","guid":{"rendered":"http:\/\/foggybottomline.com\/?p=348"},"modified":"2018-08-31T14:13:08","modified_gmt":"2018-08-31T18:13:08","slug":"comment-at-virginia-right","status":"publish","type":"post","link":"https:\/\/foggybottomline.com\/?p=348","title":{"rendered":"Comment at Virginia Right"},"content":{"rendered":"<p>Ellwood Sanders is a regular contributor to <em><a href=\"http:\/\/www.varight.com\/\">Virginia Right<\/a><\/em>, a conservative blog edited by <a href=\"http:\/\/www.varight.com\/contact-us\/about-2\/\">Tom White<\/a>.\u00a0 Yesterday he <a href=\"http:\/\/www.varight.com\/news\/the-rule-of-law-is-at-stake-thats-all\/\">posted an article\u00a0<\/a>criticizing <a href=\"https:\/\/en.wikipedia.org\/wiki\/Leslie_Cockburn\">Leslie Cockburn\u00a0<\/a>and <a href=\"https:\/\/en.wikipedia.org\/wiki\/Chuck_Schumer\">Chuck Schumer<\/a> for having \u201cperverted legal questions into political ones.\u201d\u00a0 It seems Cockburn tweeted that the Trump Administration demonstrated its \u201clack of respect for states\u2019 rights and Virginians\u2019 health.,\u201d and Schumer pointed out that the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Brett_Kavanaugh\">Bret Kavanaugh\u00a0<\/a>nomination \u201cwould put a dagger through the heart\u201d of Democrats\u2019 belief that health care is America\u2019s number one issue.<!--more--><\/p>\n<p>This is pretty bog-standard right-wing blogging, with all the projection and terrible logic one often finds.\u00a0 So of course I had to post a comment:<\/p>\n<blockquote><p>Whether or not Virginia&#8217;s uranium mining ban violates the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Atomic_Energy_Act_of_1954\">Atomic Energy Act of 1954<\/a> is certainly a legal question.\u00a0 But the decision to file a friend of the court brief arguing that it does is a political one.\u00a0 A Democratic administration would likely have chosen not to.\u00a0 Cockburn is right to point this out.<\/p>\n<p>And Schumer is right to point out that a conservative Supreme Court is more likely to strike down existing or future progressive legislation.\u00a0 For all their talk about &#8220;legislating from the bench,&#8221; it&#8217;s conservatives like Mitch McConnell and anti-abortion activists who have most recently politicized the Supreme Court.\u00a0 If the right in fact only wants &#8220;qualified judges&#8221; on the SCOTUS, Merrick Garland would have a seat.<\/p>\n<p>Conservatives understand that majorities of Americans favor progressive policies like protecting the environment and access to health care.\u00a0 They know Americans by and large also oppose conservative ones like tax cuts for the wealthy and restricting the right of women to reproductive health care.\u00a0And they know all too well that they can win at the polls only by rigging the system through voter suppression or gerrymandering.\u00a0 So they pack the courts with conservatives to protect their anti-democratic efforts to choose their voters.\u00a0 But they also know that this won&#8217;t work forever, so they also need to pack the courts to block progressive legislation when their hold on power finally ends.<\/p>\n<p>In the end, the Supreme Court is no less a political branch of government than Congress or the Executive &#8211;
